What is Copyright?
Copyright is the right to copy or not to copy your work and the right to limit its reproduction. In Canada it covers all original literary, dramatic, musical and artistic works and the copyright usually falls to the creator. The Copyright Act covers fixed expressions of an idea but not the ideas themselves. The Canadian Copyright act has very recently undergone some revisions.
Who Holds Copyright?
As a freelance artist you maintain copyrights unless you sell them or agree to let someone else take over copyright of your work.If a piece is comissioned the creator holds the copyright until payment is made. If you create works while in the employment of someone the copyright may fall to them, unless you have another agreement. When your work is reproduced in an any way in part or whole without your expressed permission, this is a copyright infringement. As a Canadian citizen, when you create work that is normally covered by the Copyright Act
you autonmatically control the copyright unless ortherwise agreed.
What Are Moral Rights?
Moral rights means that no one (even the copyright holder) has the right to change, use or modify your work in a way that would damage or predjudice your reputation or honour.In Canada moral rights are held by the creator of an original work and cannot be sold or transfered but may be waived.
Copyright issues are especially important to illustrators when dealing with stcok houses and stock imagery. Digital technology has made it easy for people to "borrow " work.
